~Case Studies~We are continually searching for information in past or current cases where we feel that the use of a private investigator would have been useful in the criminal or civil defense case. If you come across a case that is pertinent and would like to have it posted on the site, email the request to: caselaw@defensesupport.net Ineffective Assistance of Counsel: We have come across some cases in where appeals have been filed and in some cases finding the attorney Ineffective, for failure to hire a private investigator. Follow the links below to read a few of the cases that we have found. There are actually hundreds of cases that have been filed with this being cited. I must point out though, in all cases this was not the only allegation that the appellant brought forward during the appeal but is frequently cited in many appellate cases. Michael Brewer vs. State of Maine: This case was also overturned for failure to investigate the case properly. The appellate court ruled in favor of the defendant. Paul Wallins vs. Commonwealth of Massachusetts: (S.J.C. Order of Term Suspension entered by Justice Sosman) After reading this case, I thought it had to be posted on the site. This defendant did not only win his appellate case, but also a civil suit against the attorney of record. Attorney was disbarred for 2 years. There are many more cases that I will be posting soon. The reason I post some of these past cases is not because an investigator should be appointed to every case, it's that an investigator should be considered in every case to exhaust all efforts of due-diligence. Many attorneys will commonly state that attorneys are not investigators and that investigators are most definitely not attorneys. Together though they offer the best defense a defendant deserves. Through research on the web, I am finding that nationally as a whole more criminal and civil defense attorneys are either hiring in-house investigators or use an investigative service regularly as part of their business to avoid situations of appellate rulings as indicated above. As important as the hiring of a criminal or civil defense lawyer, the hiring of a criminal or civil defense investigator is equally as important.
